Abstract: This recommendation, adopted by the Committee of Ministers on 25 November 1981 at the 340th meeting of the Ministers’ Deputies, lays out eight principles on access to information, which it recommends member states to use as guide in their law and practice. The principles stipulate, among other things, that everyone shall have the right to obtain information held by the public authorities other than legislative bodies and judicial authorities; that effective and appropriate means shall be provided to ensure access to information, within a reasonable time; and that this access shall not be refused on the ground that the requesting person has no specific interest in the matter. The principles also specify the only limitations and restrictions that shall apply (such as national security, public safety and the protection of privacy), but add that a public authority refusing access to information shall give the reasons on which the refusal is based, and any refusal shall be subject to review on request.
